Texas State Fire Marshal Rules (28 TAC Chapter 34, Subchapters C, E, F and G) 34.521: Red tags for unsafe or inoperable extinguishers and systems, with immediate owner notice, AHJ notice within 24 hours and three business days, and notice of correction within five

What does 34.521 require?

Where impairments leave a portable or fixed system unsafe or unable to operate, the firm tells the owner or representative at once and in writing about every impairment, tells the local authority having jurisdiction, where there is one, within 24 hours by telephone, fax or email, and sends the AHJ a copy of the written owner notice within three business days. A completed red tag is attached to show that correction or replacement is needed; the licensee's signature certifies the listed impairments. No service tag goes on until the impairments are corrected or the unit replaced and re-inspected in good working order, and the AHJ is told within five business days when corrections are made and the red tag is removed or revised. Red tags match service tags in size, carry the do-not-remove, equipment-impaired inscription in capitals of at least 10-point bold type, and carry the firm's name, address and certificate number, the licensee's name, licence number and handwritten signature, the date, the list of impairments and the owner's or occupant's name and address. Only an authorised registered-firm employee who has corrected the impairments and certified the service, the State Fire Marshal's Office or another regulatory agency may remove a red tag.
