Subchapter E: fire extinguisher rules (34.501 to 34.523) – Texas State Fire Marshal Rules (28 TAC Chapter 34, Subchapters C, E, F and G)

Texas State Fire Marshal Rules (28 TAC Chapter 34, Subchapters C, E, F and G) 34.510-a-d: Fire extinguisher firms and branches hold a certificate of registration, employ a licensed person, keep a physical business location and a Type C registration for DOT cylinder testing

What does 34.510-a-d require?

Any firm, and any branch office, that leases, rents, sells, installs or services portable extinguishers, or plans, certifies, installs or services fixed extinguisher systems, must first obtain a certificate of registration from the state fire marshal. Before doing business the firm must employ at least one licensed person who is properly equipped for the acts the certificate authorises; the firm's permitted activities are limited to those its employees' licences allow. Hydrostatic testing of DOT specification extinguisher cylinders needs a separate Type C registration. The firm keeps a specific physical business location, shown on the certificate (not a mailing address or post office box).
