Unless exempt under Schedule 1A, a person must not carry out, or undertake to carry out, building work without a contractor's licence of the appropriate class. Maximum penalty 250 penalty units for a first offence, 300 for a second, and 350 penalty units or 1 year's imprisonment for a third or later offence or where the work is tier 1 defective work (grossly defective work that makes the building unusable for its purpose or is likely to cause death or grievous bodily harm); at that level an individual commits a crime. A person who carries out unlicensed work has no right to payment, except reasonable remuneration capped at the actual cost of materials and labour supplied, excluding their own labour, profit, unreasonably incurred costs and amounts for their own benefit, and not above the agreed price.
