A licensee that is a company must not carry out, or undertake to carry out, building work unless it has a nominee who holds a contractor's or nominee supervisor's licence covering the work under the company's class of licence. There is no offence if the company has been without a nominee for less than 28 days. Maximum penalty 250, 300 and 350 penalty units for first, second and third or later offences or tier 1 defective work. The company must notify the Commission within 14 days of ceasing to have or changing its nominee (s 55).
