A person may contract to do residential building work or specialist work only as, or on behalf of, an individual, partnership or corporation holding a contractor licence that authorises contracting for that work. A licence holder who has contracted to do residential building work must not subcontract any of it to a person who does not hold a contractor licence for work of that kind; the same applies to any work for which the Act requires insurance. A developer must not contract with anyone to do residential building work on its behalf unless that person holds a contractor licence for that kind of work. For the subcontracting and developer offences it is a defence to show that everything reasonably required to prevent the contravention was done. Maximum penalties are 1,000 penalty units for a corporation and 200 otherwise, and a second or later offence by an individual can bring 500 penalty units or 12 months' imprisonment.
