A licensed contractor (other than a construction manager) must ensure its building work is personally supervised by the company's nominee, by an officer or employee holding a nominee supervisor's, site supervisor's, fire protection occupational or occupational licence of the relevant class authorising supervision, or by an individual holding a contractor's licence of the relevant class (for an individual contractor, by the contractor or such an employee or licensee); for a company, both the company and its nominee carry this duty. The work must also be adequately supervised, judged by: whether there is a supervision system and how it is implemented; whether the work follows the contract plans and specifications; whether it meets the standard of a competent licensee of that class; whether the control, direction and the number, timing and quality of inspections by an authorised supervisor are sufficient for the work's size and complexity; and whether an authorised supervisor checks the work at completion and before final payment. Maximum penalty 200 penalty units for an individual and 1,000 for a company.
