A Division 1A contract must include, and is taken to include, the Schedule 2 Part 1A terms: the contractor will tell the owner if a registered certifier is required for particular work; selecting the certifier is the owner's sole responsibility (subject to the planning law provisions on certifier appointment); and the contractor will not object to the owner's choice. Inconsistent terms are unenforceable to that extent.
