A licence holder must not unduly influence, or attempt to influence, the owner's appointment of a registered certifier for work under the contract. The holder is taken to have attempted undue influence if it makes the appointment (or non-appointment) of a particular certifier or class of certifier a condition of contracting, offers to change the price depending on which certifier is appointed, or refuses to carry out work depending on the certifier chosen. Maximum penalty 1,000 penalty units for a corporation and 300 otherwise.
