For building work that requires a contractor's licence, a licensed contractor must not contract with a person to carry out the work unless that person holds a contractor's licence of the appropriate class. It is a defence to prove all reasonable action was taken to ensure compliance. Maximum penalty 80 penalty units for a first offence, 120 for a second and 160 for a third or later.
