NSW Food Regulation 2025
Part 4: food safety schemes, general provisions: licensing, food safety programs, inspections and audits (sections 31 to 49) – NSW Food Regulation 2025

NSW Food Regulation 2025 42: Pay licence fees and levies by the date in the Food Authority's notice (at least 42 days out), keep to any instalment approval, and expect overdue treatment of the whole balance if an instalment is missed

What does 42 require?

Licence fees are worked out under each scheme's fee section and Schedule 3 (summed where one licence covers several businesses), and seafood levies under the shellfish levy sections; the Authority must send a notice before expiry giving the amount, the method and a due date at least 42 days after the notice. A holder may ask, before expiry, to pay by instalments; once approved, each instalment must be paid on time, and a missed instalment lets the Authority treat the whole unpaid remainder as overdue. The Authority may reduce, waive or pro-rate fees for part years. Fee amounts may rise yearly with Sydney CPI.
