NSW Food Regulation 2025
Part 4: food safety schemes, general provisions: licensing, food safety programs, inspections and audits (sections 31 to 49) – NSW Food Regulation 2025

NSW Food Regulation 2025 40-41: Treat the licence as personal to the holder, and renew it by paying the notified licence fee (and any seafood levies) or the approved instalment before expiry

What does 40-41 require?

A licence cannot be transferred, so a new owner or operator applies for its own licence. The holder applies for renewal simply by paying, before the licence expires, the total in the Food Authority's renewal notice (licence fee plus, for seafood businesses, the shellfish program levies) or the instalment due under an instalment approval. The Authority may renew, with or without conditions, or refuse on any ground that would justify suspension or cancellation, refunding the payment if it refuses.
