NABERS - National Australian Built Environment Rating System ATR-6: Give accurate information, keep project records seven years and notify transfers

What does ATR-6 require?

Agreement to Rate clauses 6, 7, 9 and 10: the applicant warrants authority, the absence of undisclosed conflicts, and that information supplied is accurate, complete and not misleading, repeats the warranties daily and notifies anything affecting them; it must not reproduce NABERS intellectual property for public or commercial purposes without written authorisation, and indemnifies and releases the National Administrator. It keeps project records (design and as-built drawings and specifications, milestone progress) for at least 7 years after the agreement ends, supplies them and allows audit and inspection. Before disposing of project rights it gives a Notice of Dealing at least 30 business days ahead with the buyer's details, after which the National Administrator may terminate, require novation or sign a new agreement. Confidentiality and privacy duties apply, and misleading conduct allows immediate termination.
