Agreement to Rate clauses 2 to 4 and 8.1: a developer or owner of a new or refurbished building commits to obtain certified performance ratings (Energy, Water, Embodied Carbon, and for offices Indoor Environment and Waste) once it operates. The agreement binds only when the project details are completed, signed and the non-refundable fee paid and the National Administrator countersigns. The applicant must promptly notify the Occupancy Certificate Date, which must fall within 6 years of the agreement, engage and pay an independent accredited assessor (no involvement in design, construction, commissioning or with the applicant), tell the assessor to select the Agreement to Rate option at lodgement, comply with the Rules, and obtain and notify every certified rating within 2 years of occupancy; missing either milestone allows termination. The National Administrator may publish the applicant, project, space type, scope, status and rating.
