Part 748: Applications and support documentation – EAR - Export Administration Regulations

EAR - Export Administration Regulations 748.9: 748.9 Support documents for license applications

Support documents are required for certain applications involving the PRC (748.10, 748.11(a)(2)), 600 Series Major Defense Equipment (748.11), firearms to OAS members (748.12) and Hong Kong (748.13), and may be required case by case, with exceptions for U.S. and foreign government consignees (other than the PRC), registered relief agencies, temporary exhibits, short supply items, software and technology, and 5A002, 5A004 and 5B002 encryption items. Documents need English translations and explanations of coded terms; the application must disclose all facts and a support document cannot extend a licence; the applicant must still disclose any known inconsistent facts and promptly report changes; applications may be filed before the document arrives but nothing may ship until it is obtained; originals or copies must be kept under Part 762; a 45-day grace period follows new requirements.
