Part 748: Applications and support documentation – EAR - Export Administration Regulations

EAR - Export Administration Regulations 748.11: 748.11 Statement by Ultimate Consignee and Purchaser

Applications including licensed 600 Series Major Defense Equipment to destinations other than the PRC require a Statement by Ultimate Consignee and Purchaser (letterhead statement per Supplement No. 3 or Form BIS-711), unless the applicant is itself the consignee and includes the statements in Block 24; for the PRC it may replace the End-User Statement for servicing parts of $75,000 or less. Responsible officials with personal knowledge and authority to bind and to control disposition must sign; separate entities sign separately; no alterations after signature (a new statement is needed), with prompt replacement statements if facts or intentions change; the first application must follow within one year of signature and later ones within four years.
