Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2) s99D-F: ss 99D to 99F No post-supply fees on gift cards and no void terms

A business must not supply a gift card whose terms allow or require a post-supply fee (a fee charged after supply, such as activation, account keeping or balance enquiry fees), and must not demand or receive such a fee. Reg 89B allows booking fees charged equally for other payment methods, currency exchange fees, reissue fees for lost, stolen or damaged cards, and payment surcharges. Terms allowing post-supply fees or cutting the redemption period below 3 years are void, and the supplier must ensure the terms do not include them.
