A person must not, in connection with supplying goods or services to a consumer, give a document evidencing a warranty against defects (a representation at or about the time of supply that a person will repair, replace, resupply, rectify or compensate if the goods or services are defective) that does not meet the prescribed requirements, or represent directly to the consumer that the goods or services carry such a warranty. Reg 90 requires the warranty to be in a transparent document that: concisely states what the warrantor must do to honour it and what the consumer must do to claim; prominently states the warrantor's name, business address, telephone number and email (if any); states the period within which a defect must appear; sets out the claim procedure and the address for claims; states who bears the cost of claiming and, if the warrantor, how to claim expenses; states that the warranty benefits are in addition to other rights and remedies under law; and includes the mandatory statement for goods, for services or for goods and services (reg 90(2) to (4), the services and combined texts apply to warranties issued from 9 June 2019 under reg 99), except for services outside the guarantees (s 63) and prescribed energy and telecommunications supplies (s 65).
