Chapter 3 Part 3-2 Divisions 3 to 4: Lay-by, gift cards, receipts, warranties and repairs – Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2)

Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2) s103: s 103 and reg 91 Repairers must give the prescribed notice before accepting consumer goods for repair

A repairer must not accept goods acquired by a consumer for repair without giving the person a notice that meets the prescribed requirements. Reg 91 requires the notice to state that repair may result in loss of user-generated data where the goods can store data (files, contacts, music, saved games), and, where it is the repairer's practice to supply refurbished goods instead of repairing or to use refurbished parts, to include the text 'Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.'
