Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2) s98-99: ss 98 and 99 Supplier terminates lay-by only for breach, cessation or unavailability, and refunds on any termination

A supplier must not terminate a lay-by agreement unless the consumer breached a term, the supplier has stopped trading, or the goods are no longer available (s 98). On termination by either party, the supplier must refund all amounts paid other than any termination charge payable under the agreement, may recover an unpaid termination charge as a debt, and has no other remedy for the termination (s 99).
