At engagement the employer must agree in writing with each part-time employee (fewer than 38 ordinary hours a week, reasonably predictable hours) a regular pattern of work stating the hours on each day of the week (the guaranteed hours), start and finish times each day, and when meal breaks may be taken and for how long. The pattern may be varied by agreement, temporarily or ongoing, recorded in writing before the end of the affected shift (for a particular rostered shift) or otherwise before the variation takes effect; emails and text messages suffice; a variation cannot take the employee to 38 or more ordinary hours. The employer must keep a copy of the agreement and every variation and give the employee a copy on request. Part-time employees are paid annual and personal/carer's leave pro rata and are covered by the award as full-time employees are unless it says otherwise.
