A part-time employee whose guaranteed hours are below the ordinary hours they regularly worked over the previous 12 months may ask in writing, once every 12 months, for their guaranteed hours to be increased to match. The employer must respond in writing within 21 days, may refuse only on reasonable grounds, and before refusing must discuss the request and genuinely try to agree an increase that gives more predictable hours and accommodates the employee's circumstances. An agreed increase must be recorded in the response; a refusal must give the grounds and how they apply. Disputes go to clause 36.
