Victoria Occupational Health and Safety Regulations 2017 r98: r 98 Employer must control plant risk using the hierarchy of control

A self-employed person or employer must eliminate plant risks as far as reasonably practicable. Where elimination is not reasonably practicable, the risk must be reduced as far as reasonably practicable by replacing the plant with lower-risk plant, isolating the plant from people, applying engineering controls, or a combination of these. If risk still remains, administrative controls must then be used to reduce it as far as reasonably practicable, and only after that may any residual risk be addressed by giving appropriate personal protective equipment to those at risk. No other regulation in Division 5 except r 96 limits this duty. Employees and any health and safety representative must be consulted on control decisions.
