Victoria Occupational Health and Safety Regulations 2017 r104: r 104 Employer must install, commission and decommission plant safely

A self-employed person or employer must ensure that: plant is installed or erected with enough clear working space around it for it to be used with the risk eliminated as far as reasonably practicable, or otherwise reduced as far as reasonably practicable; the layout of plant does not, as far as reasonably practicable, impede entry to or exit from the workplace so as to create a risk; plant is not commissioned until it has been established, as far as reasonably practicable, that commissioning is safe; plant is not decommissioned until it has been established, as far as reasonably practicable, that decommissioning is safe; and installation, erection, commissioning, decommissioning and dismantling include inspections that monitor the risks of those activities. The duty to control risk continues for as long as the plant stays in operation, up to its decommissioning.
