A manufacturer must build and inspect plant having regard to the designer's information under Division 2 and s 27(1)(c) (Act), and test it as that information requires. If a hazard with no designer-provided risk control is found in the design during manufacture, the manufacturer must keep the hazard out of the plant being made, inform the designer in writing without delay, as soon as that is reasonably possible, and take all reasonable steps to consult the designer about changing the design to fix it. If the designer cannot be informed, the manufacturer must itself eliminate the risk or, if that is not reasonably practicable, reduce it as far as reasonably practicable. Once such a hazard is identified the plant must not be made until the designer supplies revised information under r 82(a) or the manufacturer has dealt with the risk itself; if the designer states in writing under r 82(b) that no revision is needed, the manufacturer may continue on the original information.
