If an operator, having consulted under s 35 of the Act, adopts a risk control measure for a major mining hazard, it must tell the health and safety representative, or the employees where there is no representative, why it adopted that measure and why it rejected any alternatives discussed during the consultation. Maximum penalty is 60 penalty units for an individual and 300 for a body corporate.
