Every mine operator must arrange continuing health monitoring for an employee whose work exposes them to a mining hazard that could reasonably be expected to harm their health, or whose condition, the operator reasonably believes after consulting a registered medical practitioner, exposes them or another person at the mine to a health or safety risk given the nature of the work. Where monitoring includes a medical examination, the examination must be confined to the employee's mine work, be carried out or supervised by a registered medical practitioner, and occur at a frequency the operator sets with a registered medical practitioner. These duties extend to independent contractors.
