Every mine operator must ensure, as far as reasonably practicable, that nobody enters without permission, other than inspectors and people authorised under s 87 of the Act; that no one under 16 is engaged for work in open cut workings or an underground mine; and that no one under 18 is engaged underground unless over 16 and an apprentice or trainee who is directly supervised by a supervisor the operator has authorised and who is suitably qualified and experienced. For those apprentices and trainees the operator must ensure they receive directions, demonstrations and monitoring suited to their tasks and competence so they can work safely; that immediate action can be taken to rectify a hazard if an emergency involving them arises; and that they remain under direct supervision unless the supervisor reasonably believes the task makes it impracticable or unnecessary, their competence makes it unnecessary, and less supervision will not put anyone at risk.
