A prescribed mine's operator must prepare an emergency plan addressing all aspects of emergency response, including a system to locate promptly everyone in the mine at any time, adequate rescue equipment, and persons trained in that equipment being on site or on call whenever anyone is working. It must be prepared with the emergency services responsible for the area and, for major mining hazards that could affect people nearby, any municipal council there; documented so users can readily understand it; and able to be implemented immediately for an incident carrying a significant risk of death or serious injury. The operator must put it into effect straight away when responding to such incidents and keep it ready for an inspector to examine on request. Maximum penalty for the availability duty is 100 penalty units (natural person) and 500 (body corporate).
