The employer must review, and revise where needed, its hazardous substance risk controls: before any change to systems of work likely to alter those risks; when a registered medical practitioner advises under r 169(2)(c)(i) that health monitoring has found adverse health effects; after any Part 5 (notifiable) incident involving a hazardous substance; whenever the controls do not adequately control the risks for any other reason; and when a health and safety representative asks for a review. An HSR may ask for a review if they reasonably believe one of the first four triggers exists, or that the employer has not reviewed properly or has ignored one of those triggers in reviewing or revising. The duty supports sections 21 and 23 of the Act.
