An employer must make sure any container in which a hazardous substance arrives at its workplace carries the manufacturer's or importing supplier's label, and that label stays legible and is not removed, defaced or altered. Where the substance is decanted into another container on site, that container has to be clearly marked with the product identifier, or, if that is not reasonably practicable, the substance has to be identified by some other means. Decanting labels are not needed where the decanted substance is used up at once and the container is immediately cleaned so it poses no health risk, or neutralised, cured or chemically deactivated so any residue is harmless. Maximum fine: 100 penalty units (individual) or 500 (body corporate), for each duty.
