Regulation 124 prescribes plant for the purposes of Act s 37(2)(e)(i). The prescribed plant is every type in r 74(1) except material-processing plant (a) and lasers (f), namely plant that lifts or moves people or materials, pressure equipment, tractors, earthmoving machinery, scaffolds, temporary access equipment, explosive-powered tools, turbines and amusement structures. An incident in which any of this plant collapses, overturns, fails, malfunctions or is damaged and so puts someone at serious risk through an immediate or imminent exposure is therefore a notifiable incident under Part 5 of the Act. The self-employed person or employer in control of the workplace must then tell the Authority straight away once aware of it, lodge a written record in the approved form within 48 hours, retain that record for no less than 5 years and preserve the site as required by the Act.
