UK Privacy and Electronic Communications Regulations 2003 (PECR) Reg.22(2): Regulation 22(1), (2) and (4): Marketing emails and texts to individuals only with prior consent

A person must not send, or instigate, unsolicited direct marketing by electronic mail (including text, voice, sound or image messages stored in the network or device, such as SMS) to individual subscribers unless the recipient has previously notified the sender of consent to such messages from or instigated by that sender, or the soft opt-in in paragraph (3) or the charity soft opt-in in paragraph (3A) applies. A subscriber must not allow its line to be used in breach. Messages sent but not received count, the recipient being read as the intended recipient.
