Unsolicited direct marketing by calls, fax, email and text (regulations 19 to 24) – UK Privacy and Electronic Communications Regulations 2003 (PECR)

UK Privacy and Electronic Communications Regulations 2003 (PECR) Reg.21(1): Regulation 21(1) and (3) to (5): Live marketing calls: objections and TPS and CTPS screening

A person must not make, or instigate, unsolicited direct marketing calls where the subscriber has told the caller not to call that line, or where the number is listed on the Telephone Preference Service register kept under regulation 26 (which also holds corporate subscribers' numbers, the Corporate TPS), unless the number has been listed for fewer than 28 days or the subscriber has told that caller it does not for the time being object to its calls, a permission the subscriber can withdraw at any time. The rule does not cover calls falling under regulations 21A and 21B, which have their own stricter consent rules.
