Chapter 4: Ensuring AI ethics and reliability (duties on AI business operators) – South Korea AI Basic Act

South Korea AI Basic Act 40: Cooperate with fact-finding surveys and comply with cease or corrective orders

What does 40 require?

Where a breach of the transparency duties (Article 31(2) and (3)), the safety duties (Article 32(1) and (2)) or the high-impact AI responsibilities (Article 34(1)) is found or suspected, or reported or complained of, the Minister may require the operator to submit data or have officials investigate, including entering offices and business premises to examine ledgers, documents and other items under the Framework Act on Administrative Investigation. An operator found in breach may be ordered to take the measures needed to cease or correct the breach; non-compliance with such an order attracts an administrative fine of up to 30 million won.
