The Regulator's Telecommunications (Goods and Service Promotions and Advertising) Guidelines 2023 apply to all telecommunications licensees (not to broadcasters' third-party adverts). Promotions must be fair and transparent; promotional tariffs are offered only on approved 12-month tariffs; materials state dates, draw times, terms and entry or prize limits, prize descriptions, eligibility restrictions, unexpected costs and redemption points; opt-in and opt-out steps appear in both languages; bonus allowances in bundles are consumed first; no misleading or deceptive conduct, with care over phrases like 'chance to win'; draws are transparent and recorded, and results published; offers and terms are communicated in Samoan and English and on the operator's website; benefits may vary with spend but not by race, sex, age, disability, religion or culture; eligibility conditions are stated; customers can easily stop messages. Advertisements must not mislead; must be truthful, decent, compliant and simple, with accessible terms; factual claims must be substantiated on request; adverts must be in Samoan; violence is not promoted; superlatives are avoided; competitors are not disparaged or imitated; the provider is identified with contact details; subscriptions, terms and pricing are indicated; complex pricing in transient media is backed by detailed web and social media explanations. Filings: revisions of promotions are submitted five working days before start; applications state whether new, revised or extended; dominant providers file new promotions seven working days before they take effect and notify all customers for seven days before service changes; short-code promotions with gambling elements need a Gaming Control Authority licence. Continued breaches lead to warnings, pre-approval of adverts, a meeting and an order.
