In every regulated contract the contractor warrants that materials it (or the person carrying out managed work) supplies will be good and suitable for their purpose, judged by generally accepted industry practices and standards or manufacturers' and suppliers' specifications and recommendations, and new unless the contract says otherwise. The warranty does not apply to materials the owner nominated specifically and unprompted by the contractor, where there were no reasonable grounds against them or the owner insisted after written advice not to use them, and does not bind the owner where the owner's architect directs supply.
