NSW Home Building Act 1989 s18B: s 18B Perform the work to the statutory warranties

Every contract to do residential building work carries warranties by the licence holder (or person required to be licensed) that: the work is carried out carefully and skilfully and follows the contract plans and specifications; materials the contractor supplies are good, suitable for their use and new unless the contract says otherwise; the work complies with this Act and all other laws; the work proceeds diligently and finishes within the contract time or, if none, within a reasonable time; for construction, alteration, repair, renovation, decoration or protective treatment of a dwelling, the work, as far as it goes, leaves a dwelling reasonably fit to live in; and where the owner expressly makes known a particular purpose or desired result showing reliance on the contractor's skill and judgment, the work and materials will be reasonably fit for it. The warranties are also implied in subcontracts between the principal contractor and a subcontractor. They run to successors in title and non-contracting owners (s 18D), cannot be excluded (s 18G) and are the benchmark for improper conduct (s 51).
