For a residential building work contract above the prescribed amount, a progress payment (a payment on account after work starts) may be demanded, received or contracted for only if it is: a specified amount or percentage of the price payable on completion of a stage of work described in clear and plain language; a payment for labour and materials for work already done or costs already incurred (a margin may be added), supported by reasonably necessary invoices or receipts, at intervals fixed by the contract or as invoiced; or a kind authorised by the regulations. A contract can combine kinds, and progress payments can cover variations. The section does not apply to contracts under the Security of Payment Act, contracts between licence holders for work each is licensed for, or specialist work that is not residential building work. Maximum penalty 1,000 penalty units for a corporation and 200 otherwise.
