The maximum deposit (a payment on account before work starts under a contract to do residential building work) is 10% of the contract price. A person must not demand or receive a deposit above that amount, or enter into a contract entitling them to one. The regulations may set how the contract price is worked out. Contracts between licence holders for work each is licensed for, and specialist work that is not residential building work, are excluded. Maximum penalty 1,000 penalty units for a corporation and 200 otherwise. Where Part 6 insurance is required, no deposit may be taken before the insurance certificate is given (s 92(2)).
