NSW Home Building Act 1989 s5: s 5 No offering or advertising of work by or for an unlicensed person

An individual, partner, company officer or company must not represent that the individual, partnership or corporation is prepared to do residential building work or specialist work unless it holds a contractor licence authorising it to contract for that work, and no person may make such a representation on another's behalf knowing that the other lacks the appropriate licence. Representations include advertisements (s 18). Maximum penalty 1,000 penalty units for a corporation and 200 otherwise; a repeat offence by an individual can bring 500 penalty units or 12 months' imprisonment.
