Netherlands Works Councils Act (WOR) 5a(2): Art. 5a(2) Notify the business committee of a voluntary works council and of its abolition

Where no duty to institute a council exists (or no longer exists), the entrepreneur may decide to set up or keep a works council voluntarily; the Act applies to it once the entrepreneur has notified that decision in writing to the competent business committee (bedrijfscommissie). The entrepreneur may abolish such a council at the end of its term only on a significant change of circumstances, and notifies the abolition in writing to the business committee. Art. 5a(1) applies the Act equally to a council required by a collective labour agreement or public-law employment terms.
