Netherlands Works Councils Act (WOR) 35b(5): Art. 35b(5) Ask staff for advice on decisions affecting jobs or working conditions of a quarter of them

In a staff meeting the entrepreneur gives the workers the opportunity to advise on every proposed decision that may lead to loss of jobs or to a significant change in the work, the terms of employment or the working conditions of at least a quarter of them, at a time when the advice can still substantially influence the decision; the duty does not apply where the matter is already regulated in substance for the undertaking by a collective labour agreement or public-law terms. The introduction of a monitoring system that significantly changes how a quarter of the workforce works falls within this duty.
