Netherlands Works Councils Act (WOR) 2(1): Art. 2(1) Institute a works council at 50 or more workers and observe the Act towards it

An entrepreneur maintaining an undertaking where 50 or more persons normally work must, in the interest of the undertaking functioning well, set up a works council for consultation with and representation of those persons, and must comply towards it with every rule laid down by or under the Act. Persons working in the undertaking (art. 1(2) and (3)) include employees and public servants of the entrepreneur, temporary agency workers after 15 months in the undertaking, and the entrepreneur's employees working in an undertaking of another entrepreneur; directors are not counted. If the headcount falls below 50, the council ends at the end of its current term unless the entrepreneur keeps it voluntarily under art. 5a(2).
