An entrepreneur maintaining an undertaking with normally at least 10 but fewer than 50 persons and no works council may set up an employee representation body (personeelsvertegenwoordiging, PVT) of at least three persons elected directly by secret written ballot, and must set it up at the request of a majority of the persons working there. Many council provisions then apply to the PVT (art. 35c(3)): facilities, time off, protection against disadvantage, costs of legal proceedings, the information right of art. 31(1), agreements under art. 32 and the dispute procedure. An entrepreneur with fewer than 10 persons may institute a PVT voluntarily (art. 35d).
