Under the Disclosure Affected Buildings Determination 2016 (s 5 and s 6), since 1 July 2017 a building, or an area of a building offered for lease or sublease, is disclosure affected when at least 75 % of the building's Net Lettable Area (Gross Lettable Area if NLA is unavailable) is used for administrative, clerical, professional or similar information-based activities including their support facilities, and that office space (in the building, or in the area) is at least 1,000 square metres. It is not disclosure affected while the building is new and its certificate of occupancy has not issued or is under 2 years old, within 2 years of the certificate of occupancy after a major refurbishment, or when held under strata title. An area may group physically separate spaces sharing access that are offered together. The owner or lessee works this out before any sale, lease or sublease offer.
