NABERS - National Australian Built Environment Rating System CBD-17: Hold a granted exemption before relying on one

Sections 17 and 17A with Regulations 5 to 5B: a person may apply to the Secretary for a building or area to be exempt from ss 11, 12 or 15, in the approved form with the prescribed information (applicant, ABN, address, the provisions, the applicant's interest, steps taken toward compliance, reasons, other affected persons with consent) and a fee of 350 dollars (indexed) except for unsolicited offers. Grounds: police or security use; non-assessable (a rating or lighting assessment cannot be worked out because of the building's characteristics, shown by an accredited assessor's assessment with a conflict-of-interest disclosure); an unsolicited offer (sole offer from a party that started negotiations, no marketing in the prior 6 months, written statements from both sides, the offer maker waiving its s 12 right; in force up to 12 months, extendable by 12 while negotiations continue, and ending on contract, termination, other negotiations or advertising); or a major refurbishment under way that an assessor finds will move the base building rating by at least half a star (12 months). Automatic exemptions apply where a s 21(1)(d) determination says so.
