For each existing tank system without secondary containment meeting 264.193, the owner or operator must determine that it is not leaking or is fit for use, with a written assessment reviewed and certified by a qualified Professional Engineer (270.11(d)) kept on file, showing adequate design, structural strength and waste compatibility against collapse, rupture or failure and considering the design standards, the waste's hazardous characteristics, corrosion protection, the documented or estimated age, and the results of a leak test (for non-enterable underground tanks, one accounting for temperature, end deflection, vapour pockets and high water table) or other certified integrity examination addressing cracks, leaks, corrosion and erosion. Tanks holding materials that became hazardous waste after July 14, 1986 must be assessed within 12 months of that date; leaking or unfit systems go to 264.196.
