EPA RCRA Hazardous Waste Management 264-SubpartCC: Part 264 Subpart CC: Air emission standards for tanks, surface impoundments and containers

Applies to tanks, surface impoundments and containers managing hazardous waste at permitted facilities (and to generator accumulation units by reference), with exemptions and exclusions listed (264.1080). The owner or operator must control emissions from each unit under 264.1084 to 264.1087 (264.1082) unless all waste entering the unit has an average volatile organic (VO) concentration at the point of waste origination below 500 ppmw (determination reviewed at least every 12 months), the organic content was reduced by a qualifying destruction or removal process, the unit is a qualifying biological treatment or LDR-compliant treatment unit, or other listed exemptions apply; waste determinations use direct measurement or knowledge (264.1083). Tanks: Level 1 controls (a fixed roof with closure devices, for tanks within the design capacity and maximum organic vapour pressure limits, with annual inspections) or Level 2 controls (fixed roof with an internal floating roof, external floating roof, fixed roof vented to a control device, pressure tank, or enclosure vented to a combustion device), with initial and at least annual inspections and first repair efforts within 5 calendar days and completion within 45 calendar days of a defect (later only where emptying the tank is needed and no alternative capacity exists) (264.1084). Surface impoundments: a floating membrane cover or a cover vented to a control device, inspected annually (264.1085). Containers: containers over 0.1 m3 and up to 0.46 m3, and larger containers not in light material service, use Container Level 1 (DOT-compliant containers or covers and closure devices kept closed); larger containers in light material service use Level 2 (DOT containers, vapour-tight by Method 21 test or annual pressure test); containers used for waste stabilisation must use Level 3 (vented through a closed-vent system to a control device), with visual inspection on receipt and at least every 12 months for containers kept a year or more, first repair efforts within 24 hours and repair within 5 calendar days or the waste is removed and the container taken out of use (264.1086). Closed-vent systems and control devices must achieve 95 percent organic reduction (or meet other limits) (264.1087); inspection and monitoring follow 264.1088; records include the unit determinations, cover and control device inspections and repairs, and exemption bases (264.1089); and reports cover control device exceedances and other failures (264.1090).
