EPA RCRA Hazardous Waste Management 264-SubpartM: Part 264 Subpart M: Land treatment

The owner or operator must run a land treatment program ensuring that the hazardous constituents the permit lists are degraded, transformed or immobilised within the treatment zone (at most 1.5 metres deep from the surface, with its bottom at least one metre above the seasonal high water table) (264.271); demonstrate before applying each waste, by field tests, laboratory analyses, available or operating data, that its constituents can be completely treated in the zone (264.272); design and operate the unit to maximise degradation, transformation and immobilisation and minimise run-off, with run-on control for a 25-year storm, run-off management for a 24-hour, 25-year storm, prompt emptying of collection facilities, wind dispersal control and weekly and post-storm inspections (264.273); not grow food-chain crops unless it shows constituents will not reach the food or feed portion or exceed levels in comparable crops, with added conditions where cadmium is applied (pH, annual and cumulative cadmium limits, or animal-feed-only crops with a plan and deed notice) (264.276); monitor soil cores and soil-pore liquid (lysimeters) immediately below the zone against background, test for statistically significant increases, and on an increase notify within seven days and apply for a permit modification within 90 days, or show another source or an error (264.278); record application dates, rates and quantities in the operating record (264.279); during closure continue operations to treat the waste, control run-on, run-off and wind dispersal, maintain the vegetative cover and continue monitoring, certified by an independent qualified soil scientist or engineer, and during post-closure care continue those measures unless soil is shown to be at background (264.280); and handle ignitable, reactive, incompatible and dioxin wastes only under the stated conditions (264.281 to 264.283).
