Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2)
Chapter 3 Part 3-3: Safety of consumer goods and product related services – Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2)

Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2) s106: s 106 Do not supply, offer, make, hold or export consumer goods that fail a mandatory safety standard

Where a safety standard for consumer goods of a kind is in force, a business must not, in trade or commerce, supply goods of that kind that do not comply, offer them for supply (other than for export), or manufacture, possess or control them for supply (a defence exists where this was not for supply other than export), and must not export them without the Commonwealth Minister's written approval. A person who suffers loss because of a defect, dangerous characteristic, foreseeable misuse or missing information that compliance would have prevented is taken to have suffered it because of the supply.

What else in your programme already covers this

This control maps to 2 controls across 2 other frameworks. If you already hold one of them, the evidence you collected for it is the starting point here rather than new work.

  • GPSR-Art.5_6_7_8 General safety requirement and assessment criteria (Articles 5-8)
  • PRO-19 Do not sell, distribute or import noncomplying, banned or recalled products, or evade testing

Every mapping shown was judged rather than inferred from wording similarity, and the ones that failed review are published too. See the coverage reports and what was rejected.
